Este trabajo intenta exponer que un pasaje de la carta de san Jerónimo a Principia inspiró a san Juan de Ávila para escribir el tratado de vida espiritual que es el Audi, filia.

El objeto de este trabajo ha consistido en averiguar las fuentes no conocidas todavía que utilizó San Juan de Ávila en su obra «Audi, filia», aunque también se recogen en él las que ya se hallaban en las ediciones anteriores y que se encuentran oportunamente indicadas.

En el presente trabajo analizamos la formación de la mujer musulmana en las revistas digitales oficiales del grupo Daesh: Dabiq y Rumiyah. Llevamos a cabo un análisis de contenido cualitativo de los artículos destinados a la mujer musulmana y aquellos en los que se habla específicamente de ellas. Para el análisis de los datos utilizamos el software Atlas.ti. Daesh promueve una clara desigualdad de género, considerando que la mujer musulmana debe ser casta, modesta, obediente, fiel y sumisa. Le otorgan roles (...) tradicionales como madre y esposa. Resulta imperante diseñar medidas educativas preventivas que incluyan la perspectiva del feminismo islámico. (shrink)

Leonardo Polo sostiene que “en cuanto dianoética la prudencia tiene tres dimensiones: la memoria, la solertia y el consejo. Si falta alguna de estas propiedades la prudencia es imperfecta”. “Esto deja claro el papel de la memoria en la ética y la necesidad de profundizar en sus objetos, pues la memoria es muy importante en el hombre, porque el hombre depende de su pasado y su modo de captar la realidad presente es imposible si no se tiene en cuenta el (...) pasado”. Para acometer esta empresa el presente estudio analiza la teoría de la memoria en el pensamiento de Polo, particularmente sus objetos. Se busca con esto completar otros estudios sobre el conocimiento sensible encaminados a elaborar una reflexión filosófica sobre lo jurídico, lo cual es indudablemente un quehacer ético. (shrink)

Can one reject copyright law and be a qualified observer of its dispositives? This question was taken up by Bertolt Brecht in an intriguing essay concerning the litigation surrounding the film adaptation ofThe Threepenny Opera(1928). Brecht here develops an experimental observation around the nature of film adaptation and cultural production in copyright. While an experimental approach to law was in itself a subversive gesture, the specific legal process enabled him to expose the paradoxical ways in which the copyright system worked.

The third edition of Webster’s International Dictionary, first published in 1961, represented a novel approach to lexicography. It recorded the English language used in everyday life, incorporating colloquial terms that previous grammarians would have considered unfit for any responsible dictionary. Many were scandalized by the new lexicography. Trademark lawyers were not the most prominent of these critics, but the concerns they expressed are significant because they touched on the core structure of the trademark as a form of property in language. In the course of eavesdropping on everyday usage, Merriam-Webster’s lexicographers picked up on the use of trademarks as common nouns: “thermos” as a generic noun for any vacuum flask, “cellophane” as a term for transparent wrapping, and so on. If Webster’s Third were to be taken as sound evidence of the meaning of words, then the danger was that some of the most familiar marks in the USA would be judged “generic” in the legal sense, and would thereby cease to be proprietary. A pesar de que tal proyecto pudiera constituir una empresa tan imposible como irritante, el propósito principal es resaltar un elemento que no suele observarse con frecuencia en la teoría del derecho: un recorrido por los diversos matices del inconsciente jurídico. El trabajo comienza con algunas referencias a su concepción particular del amor y del espectáculo como recursos (...) legales para dominar a los sujetos. Resumen Defiendo que lo novedoso de la concepción de Cicerón de los modelos basados en personajes del pasado consistió en conferirles habilidades que podían aplicarse a las disputas legales y políticas de Roma y, al mismo tiempo, mejorar el desempeño de los oradores jóvenes y aprendices mediante un modelo mixto de retórica. La destreza técnica y la prudencia práctica de estas autoridades para advertir aspectos cruciales en casos particulares y adaptarse a circunstancias adversas sirven como ejemplos para los oficios del (...) rétor y del abogado. Esas dos características, y no el amplio conocimiento o la fama que estos personajes alcanzaron, llevaron a Cicerón a reconocer a ciertos oradores y pensadores como fuentes de inspiración moral y formativa.I argue that Cicero's innovative understanding of the models based on characters from the past consisted in conferring them skills to be applied in the legal and political disputes of Rome and, at the same time, to improve the performance of young orators and apprentices with a mixed model of rhetoric. Both the technical ability and practical prudence of these authorities to see crucial aspects in particular cases and to adapt to adverse circumstances serve to the craft of rhetoricians and lawyers. These two features, and not the large knowledge or fame these figures acquired in life, took Cicero to recognise certain orators and thinkers as sources of moral and formative inspiration. (shrink)

The objective structured clinical examination is a method for assessment clinical competencies and skills. However, there is a need to improve its design in psychology programs. The aim of this study was to analyze the effect of the different scenario's presentation order with different complexity/difficulty on the autonomic stress response of undergraduate students undergoing a Psychology OSCE. A total of 32 students of Psychology Bachelor's Degree were randomly selected and assigned to two OSCE scenarios of different complexity. While undergoing the (...) scenarios, participants heart rate variability was analyzed as an indicator of participant's stress autonomic response. Results indicate that the order of presentation of different complexity/difficulty scenarios affects the autonomic stress response of undergraduate Psychology students undergoing an OSCE. Students who underwent the high-complexity scenario first, reported significantly higher autonomic stress response than students who began the OSCE with the low-complexity scenario. Highly complex or difficult scenarios require good executive functions or cognitive control, very sensitive to autonomic stress responses. Therefore, OSCE design will benefit from placing easy scenarios first. (shrink)

This article discusses the issue of abortion in the context of the dispute between progressive and neoconservative political forces in Brazil. The article analyses ADPF 442, a legal instrument known as a Motion of Noncompliance with a Fundamental Precept, which was lodged with the Supreme Court as part of a feminist litigation strategy in the country. The motion calls for the Supreme Court to decide on the constitutionality of the decriminalisation of abortion within the first 12 weeks of gestation. Methodologically, (...) the analysis combines a literature review with participant observation and corpus linguistics analysis. ADPF 442 is considered a key event in the use of judicialisation to voice demands for women’s rights in current-day Brazil, and this work examines the testimonies as representative of the discourse and strategies at play in the broader field of abortion and its major actors, both for and against its decriminalisation. El tratamiento del espacio imaginado es oportuno en un estudio sobre su filosofía jurídica toda vez que Polo sostiene que es el “lugar” en donde se elabora lo técnico. Así pues, ahí tendría su origen todo ars humano, dentro de los cuales ocuparía un lugar destacado el ars iuris. Los juristas romanos entendían el ius como el (...) “ars boni et aequi”, lo cual indicaría que la jurisprudencia desde antiguo era considerada un arte o técnica. (shrink)

The theory of the social responsibility of the firm oscillates between two extremes: one that reduces the firm's responsibility to the obtainment of (the greatest possible) profit for its shareholders, and another that extends the firm's responsibility to include a wide range of actors with an interest or "stake" in the firm. The stakeholder theory of the social responsibility of business is more appealing from an ethical point of view, and yet it lacks a solid foundation that would be acceptable (...) to a variety of schools of thought.In this paper I argue that the stakeholder theory could be founded on the concept of the common good. First, I explain the foundations of the theory of the common good, the concept itself, how it relates to the individual good, and its role in the firm. Following that, I explain how the theory of the common good could be applied to the stakeholder theory. Finally, I draw some conclusions. (shrink)

Controversies around large-scale development projects offer many cases and insights which may be analyzed through the lenses of corporate social (_ir_)responsibility (CS_I_R) and business ethics studies. In this paper, we confront the CSR narratives and strategies of _WeBuild_ (formerly known as _Salini Impregilo_), an Italian transnational construction company. Starting from the Global Atlas of Environmental Justice (EJAtlas), we collect evidence from NGOs, environmental justice organizations, journalists, scholars, and community leaders on socio-environmental injustices and controversies surrounding 38 large hydropower schemes built (...) by the corporation throughout the last century. As a counter-reporting exercise, we code (un)sustainability discourses from a plurality of sources, looking at their discrepancy under the critical lenses of post-normal science and political ecology, with environmental justice as a normative framework. Our results show how the mismatch of narratives can be interpreted by considering the voluntary, self-reporting, non-binding nature of CSR accounting performed by a corporation wishing to grow in a global competitive market. Contributing to critical perspectives on political CS(I)R, we question the reliability of current CSR mechanisms and instruments, calling for the inclusion of complexity dimensions in and a re-politicization of CS(I)R accounting and ethics. We argue that the fields of post-normal science and political ecology can contribute to these goals. (shrink)

Background Neuroimaging and lesion studies suggested that the dorsolateral prefrontal and posterior parietal cortices mediate visual metacognitive awareness. The causal evidence provided by non-invasive brain stimulation, however, is inconsistent. -/- Objective/hypothesis Here we revisit a major figure discrimination experiment adding a new Kanizsa figure task trying to resolve whether bilateral continuous theta-burst transcranial magnetic stimulation (cTBS) over these regions affects perceptual metacognition. Specifically, we tested whether subjective visibility ratings and/or metacognitive efficiency are lower when cTBS is applied to these two (...) regions in comparison to an active control region. -/- Methods A within-subjects design including three sessions spaced by one-week intervals was implemented. In each session, every participant was administered bilateral cTBS to either prefrontal, control or parietal cortices. Two concurrent tasks were performed, a real and an illusory figure task, stabilising objective performance with use of an adaptive staircase procedure. -/- Results When performing the replicated task, cTBS was found insufficient to disrupt neither visibility ratings nor metacognitive efficiency. However, with use of Kanizsa style illusory figures, cTBS over the dorsolateral prefrontal, but not over the posterior parietal cortex, was observed to significantly diminish metacognitive efficiency. -/- Conclusion(s) Real and illusory figure tasks demonstrated different cTBS effects. A possible explanation is the involvement of the prefrontal cortex in the creation of expectations, which is necessary for efficient metacognition. Failure to replicate previous findings for the real figure task, however, cannot be said to support, conclusively, the notion that these brain regions have a causal role in metacognitive awareness. This inconsistent finding may result from certain limitations of our study, thereby suggesting the need for yet further investigation. (shrink)

Hegel has a metacritical standpoint that can be related to but not reduced to the Herderian metacritique. Hegel’s philosophical language must not be understood in terms of the opposition between an ‘absolute’ and a ‘finite’ language; rather, it must be understood in terms of the opposition between abstract and concrete language. At a theoretical level, concrete language cannot be understood without assuming an organic function of memory. At the practical level, the difference between abstract and concrete language will be understood (...) as the difference between everyday language and a philosophical one. Hegel justifies this last difference by following Humboldtian standpoints.La posture hégélienne vis-à-vis du langage philosophique ne doit pas être assimilée d’emblée à la métacritique herderienne ni être comprise en termes d’opposition entre langage «absolu» et langage «fini». La métacritique hégélienne doit plutôt être comprise en termes d’une différence entre langage abstrait et langage concret. Le mode opératoire du langage concret de la philosophie se saisit en ayant recours à une fonction organique de la mémoire et en acceptant, au niveau pratique, une différence entre le langage quotidien et le langage philosophique. Je vais montrer que Hegel peut justifier cette posture en adoptant une perspective humboldtienne. (shrink)

The cases of corruption reported by the media tend almost always to involve a private party (a citizen or a corporation) that pays, or promises to pay, money to a public party (a politician or a public official, for example) in order to obtain an advantage or avoid a disadvantage. Because of the harm it does to economic efficiency and growth, and because of its social, political and ethical consequences, private-to-public corruption has been widely studied. Private-to-private corruption, by contrast, has (...) been relatively neglected and only recently has started to receive the attention it deserves. The purpose of this paper is to offer some thoughts on the nature and importance of private-to-private corruption; the legal treatment it receives in some of the world''s leading countries; and the measures that companies can take to combat it, with special consideration of its ethical aspects. In actuarial parlance, the price of an insurance policy is considered fair if customers bearing the same risk are charged the same price. The estimate of this fair amount hinges on the expected value obtained by weighting the different claims by their probability. We argue that, historically, this concept of actuarial fairness originates in an Aristotelian principle of justice in exchange (equality in risk). We will examine how this principle was formalized in the 16th century and shaped in life insurance (...) during the following two hundred years, in two different interpretations. The Domatian account of actuarial fairness relied on subjective uncertainty: An agreement on risk was fair if both parties were equally ignorant about the chances of an uncertain event. The objectivist version grounded any agreement on an objective risk estimate drawn from a mortality table. We will show how the objectivist approach collapsed in the market for life annuities during the 18th century, leaving open the question of why we still speak of actuarial fairness as if it were an objective expected value.
