Constitutional Debates, Rhetoric, and Political Philosophy in Spain’s Parliamentary History.Francisco J. Bellido - 2024 - Springer Nature Switzerland.
This book examines the conceptual contributions of constituent representatives in Spain during the nineteenth and twentieth centuries. The Spanish Parliament has been the stage for the political modernisation of the country. Constitutional debates have historically led to the gradual acknowledgement and broadening – usually unevenly – of citizens’ rights. At the same time, constitutional debates have created opportunities to design institutions and settle legal mechanisms to enforce rights and distribute state resources. The book identifies and analyses rhetorical and conceptual innovations (...)

Experimenting with Law: Brecht on Copyright.Jose Bellido - 2020 - Law and Critique 31 (2):127-143.
Can one reject copyright law and be a qualified observer of its dispositives? This question was taken up by Bertolt Brecht in an intriguing essay concerning the litigation surrounding the film adaptation ofThe Threepenny Opera(1928). Brecht here develops an experimental observation around the nature of film adaptation and cultural production in copyright. While an experimental approach to law was in itself a subversive gesture, the specific legal process enabled him to expose the paradoxical ways in which the copyright system worked.

Lexical properties: Trademarks, dictionaries, and the sense of the generic.Jose Bellido & Alain Pottage - 2019 - History of Science 57 (1):119-139.
The third edition of Webster’s International Dictionary, first published in 1961, represented a novel approach to lexicography. It recorded the English language used in everyday life, incorporating colloquial terms that previous grammarians would have considered unfit for any responsible dictionary. Many were scandalized by the new lexicography. Trademark lawyers were not the most prominent of these critics, but the concerns they expressed are significant because they touched on the core structure of the trademark as a form of property in language.

A renowned and revered scientist and clinician, Damasio has spent decades following amnesiacs down hospital corridors, waiting for comatose patients to awaken, and devising ingenious research using PET scans to piece together the great puzzle of consciousness. The Issue of Abortion in Contemporary Brazil: An Analysis of Feminist Litigation in the Supreme Court.Maria Ligia Ganacim Granado Rodrigues Elias - 2021 - Feminist Legal Studies 29 (2):159-179.
This article discusses the issue of abortion in the context of the dispute between progressive and neoconservative political forces in Brazil. The article analyses ADPF 442, a legal instrument known as a Motion of Noncompliance with a Fundamental Precept, which was lodged with the Supreme Court as part of a feminist litigation strategy in the country. The motion calls for the Supreme Court to decide on the constitutionality of the decriminalisation of abortion within the first 12 weeks of gestation. Methodologically, (...)

The world’s process of rationalization created by Modernity has left us facing a huge waste land that leads us to wonder about the sense of reality. With this demand of sense, freedom becomes destiny, as Yolanda Ruano de la Fuente shows. Regarding her conclusions about Weber and Modernity I will show the way in which sense and freedom, duty and tragedy, character and destiny, are entwined in an attempt to remake the world as a place with sense.

The theory of the social responsibility of the firm oscillates between two extremes: one that reduces the firm's responsibility to the obtainment of (the greatest possible) profit for its shareholders, and another that extends the firm's responsibility to include a wide range of actors with an interest or "stake" in the firm. The stakeholder theory of the social responsibility of business is more appealing from an ethical point of view, and yet it lacks a solid foundation that would be acceptable (...)

In this paper, we confront the CSR narratives and strategies of _WeBuild_ (formerly known as _Salini Impregilo_), an Italian transnational construction company. Starting from the Global Atlas of Environmental Justice (EJAtlas), we collect evidence from NGOs, environmental justice organizations, journalists, scholars, and community leaders on socio-environmental injustices and controversies surrounding 38 large hydropower schemes built (...)

Although virtues have gained a firm presence in the theory and practice of corporate management, humility is not ranked as one the chief virtues in the business world. In spite of this, it is an important virtue, contributing to the manager’s moral and professional quality and the development of the company’s human team. This paper explains the basic traits of humility in general and how they manifest in the manager’s life and profession, and shows, within the ethics of virtues, that (...)

Hegel has a metacritical standpoint that can be related to but not reduced to the Herderian metacritique. Hegel’s philosophical language must not be understood in terms of the opposition between an ‘absolute’ and a ‘finite’ language; rather, it must be understood in terms of the opposition between abstract and concrete language. At a theoretical level, concrete language cannot be understood without assuming an organic function of memory. At the practical level, the difference between abstract and concrete language will be understood (...)

The cases of corruption reported by the media tend almost always to involve a private party (a citizen or a corporation) that pays, or promises to pay, money to a public party (a politician or a public official, for example) in order to obtain an advantage or avoid a disadvantage. Because of the harm it does to economic efficiency and growth, and because of its social, political and ethical consequences, private-to-public corruption has been widely studied. Private-to-private corruption, by contrast, has (...)

In actuarial parlance, the price of an insurance policy is considered fair if customers bearing the same risk are charged the same price. The estimate of this fair amount hinges on the expected value obtained by weighting the different claims by their probability. We argue that, historically, this concept of actuarial fairness originates in an Aristotelian principle of justice in exchange (equality in risk). We will examine how this principle was formalized in the 16th century and shaped in life insurance (...)
